This document contains a binding arbitration agreement and a waiver of class action rights, which may have an impact on your legal rights. It is highly recommended that you thoroughly review this document prior to accessing or utilizing the online services.

This Terms of Use outlines the guidelines for accessing and utilizing Medlocker’s (also “we,” “us,” “our” and “Company”) and Affiliates’ (an entity controlling, controlled by, or under common control with a named party) online and mobile websites, platforms, services, and applications, collectively referred to as the "Online Services". By utilizing our Online Services, you are acknowledging and agreeing to comply with these Terms and our Privacy Policies.

The Company reserves the right to modify these Terms at any time, and any updates will be posted on the Online Services. The date of the last revision will be listed as the "Effective Date" at the bottom of these Terms, and such modifications will take effect immediately upon posting. By continuing to use the Online Services, you signify your acceptance of any changes to these Terms.

By accessing or registering for membership on the Online Services, you provide your electronic signature, acknowledging and consenting to enter into a binding agreement with these Terms electronically. For your records, you may print a copy of these Terms and retain it for future reference. Please note that you will require a device such as a computer or mobile phone with a web browser and internet access, as well as either a printer or storage space on your device to print and retain a copy of these Terms.

Eligibility and Program Limitations

Participation in any promotional offer, discount program, loyalty reward program, or complimentary service (collectively, “Promotions”) offered by the platform is subject to the following eligibility criteria:

  1. Cash-Pay Requirement: Promotions are available only to individuals who pay out-of-pocket for their medications or related healthcare services.
  2. Exclusion of Government Health Program Beneficiaries: Promotions are not available to any individual who is a beneficiary of, or whose prescription or service may be reimbursable under, any federal or state health care program, including but not limited to Medicare, Medicaid, TRICARE, the Veterans Health Administration, or the Children’s Health Insurance Program (CHIP).
  3. Non-Reimbursable Transactions: may not be submitted for reimbursement to any insurance plan, government health care program, or third-party payor.
  4. Verification and Attestation: The platform reserves the right to require participants to affirm their eligibility through a digital attestation and other compliant-verification tools.
  5. Termination of Eligibility: If at any time the platform determines that a participant is or has become ineligible under these terms, the platform may terminate participation and void any promotional benefit without prior notice.
  6. Program Discretion: The platform reserves the right to modify, suspend, or terminate any Promotion at its discretion or to comply with applicable federal or state fraud and abuse laws.
These restrictions are implemented in accordance with the federal Anti-Kickback Statute (42 U.S.C. § 1320a-7b(b)), Civil Monetary Penalties Law (42 U.S.C. § 1320a-7a), and comparable state laws.
